Nissan ("we", "our", or "us") is strongly committed to protecting your privacy and personal information, and ensuring transparency in doing so. Finally, this Privacy Notice also outlines your rights related to your Personal Data and how you can exercise them.

This Privacy Notice applies to your Personal Data whenever you:

  • visit and use the services provided by our Site or any other version optimized for navigation on a tablet or a mobile device; and
  • receive or view any newsletters, emails and other communications and material that we publish or send.

This Privacy Notice does not apply to Personal Data you provide to any third parties, such as Facebook or Twitter. If you decide to access or use services or products offered by or accessible through third parties, please note that this Privacy Notice will not apply to such Personal Data and any processing activities related to them.

Please also note that some of our services accessible through this Site, especially that related to searching and applying for an employment position with Nissan, involve the use of third party services. Nissan takes appropriate measures in relation to the processing of Personal Data for the purpose of your job application, including the collection and transmission of your Personal Data to the third party. Beyond our data processing for the purpose of your job application with Nissan, we have no control over third party processing activities. We recommend that you carefully read the privacy policies of any third party services before using or signing up for them.

3. What Personal Data Do We Collect?

For the purpose of this Privacy Notice, “Personal Data” means all information relating to an identified or identifiable natural person as defined under local privacy and data protection laws, such as the Act on the Protection of Personal Information (“APPI”) in Japan and the General Data Protection Regulations (“GDPR”) in Europe (“Privacy and Data Protection Laws”).

We collect your Personal Data when you visit our Site. Your Personal Data can be (1) provided directly by you, (2) collected automatically, or (3) provided by third parties.

(1) Personal Data You Provide To Us Directly

We may also disclose your Personal Data to a third party following, or in the course of, a restructuring, merger or acquisition, debt financing, sale of assets of Nissan or any other similar transaction or operation, as well as in case of insolvency, bankruptcy, or sequestration of assets during which Personal Data are transferred to third parties as Nissan’s assets.

In the event of legal proceedings, we may share information related to you that could be of assistance to us to defend our rights or resolve legal conflicts.

Finally, we share generalized statistics or Personal Data in an aggregated form for certain purposes, such as analyzing your use of our Site or services, your areas of interest and behavior.

6. How Does Nissan Protect Your Personal Data?

Nissan has implemented reasonable and appropriate technical and organizational measures in order to maintain a level of information security well adapted to the level of risk related to the processing of your Personal Data. These measures aim, in particular, to protect your Personal Data against destruction, loss, alteration, unauthorized disclosure or access, both accidental and intentional.

However, no method of transmission of data on the internet and no method of storage (in either an electronic or a physical environment) can be entirely secure. We endeavor to protect your Personal Data to the best of our abilities, but we cannot guarantee an absolute security or integrity during the transmission of your data from your system to ours. Any transmission is at your own risk.

7. Are There Any International Transfers of Your Personal Data?

The storing and processing of your Personal Data as outlined above will sometimes require that we transfer and/or store your Personal Data outside of your country or region of residence. Legislation regarding the protection of personal data of such third countries may differ from those of your country or region of residence, in particular regarding the internal management of services and commercial or marketing communications.

Where the Act on the Protection of Personal Information of Japan (the “Act”) applies and we transfer your Personal Data outside of Japan, we will take all necessary measures through contracts based on the Act and any applicable guidelines. Where GDPR applies and the country of destination is outside of the EU and does not provide a level of protection of personal data equivalent to that of the EU, we will take all necessary measures, either through an Adequacy Decision by the European Commission or, in the absence of such a decision, through appropriate safeguards such as the European Commission Standard Contractual Clauses.

8. How Long Do We Store Your Personal Data?

Nissan stores your Personal Data for a period that is reasonable and/or as required by law. The storage period will depend on the purposes for which we have collected and used your Personal Data, and as required by any relevant legislations.

In order to determine the retention period, we consider factors such as:

  • Your use of our Site and services;
  • The existence of contractual or legal obligations requiring us to retain your Personal Data for a fixed period;
  • The existence of any legal proceedings related to your use of our Site or services.

As a rule of thumb, we only store your Personal Data in active files or systems for the duration necessary for the fulfillment of the purpose for which we collected them, in compliance with applicable legislation. For example:

  • In general, we will retain all your Personal Data until the deletion of your user account, if applicable;
  • Exceptionally, and unless provided otherwise by local Privacy and Data Protection Laws, we may store your email address and your name and last name for the purpose of electronic marketing activities for no longer than 3 years starting from our last communication with you. You may at any moment exercise your right to object to the processing of your Personal Data for this purpose.

If you object to the processing of your Personal Data for electronic marketing purposes, we will retain your Personal Data for the duration necessary to comply with, and prove our compliance with, your request, and will delete your Personal Data unless they are necessary for the accomplishment of another purpose, such as the use of our Site or services.

For any other type of processing aside from electronic marketing, we retain your Personal Data for the entire duration of our commercial relationship and, at its termination, we keep your Personal Data for the maximum duration authorized by law for tax and accounting purposes. We may also archive your Personal Data for the duration of any legal obligations, after which we will periodically delete them unless further processing is necessary for other purposes mentioned above.

9. What Are Your Rights Regarding Your Personal Data?

In accordance with the applicable Privacy and Data Protection Laws, you may be able to exercise the following rights regarding your Personal Data processing by Nissan:

Right to erasure You have the right to require the Data Controller (us) to erase your Personal Data and we are obliged to erase them as requested without undue delay, when one of the following conditions applies:

you retract your consent on which the processing of your Personal Data is based, and we have no other legal bases for the processing;

you object to the data processing and we have no compelling legitimate grounds for processing your Personal Data.
Right to restriction of processing You have the right to require the Data Controller (us) to restrict the processing of your Personal Data if one of the following conditions applies:

you contest the accuracy of your Personal Data, and wish to restrict the processing of your data during the period required of us to verify the accuracy of your Personal Data;
·
the data processing is unlawful and you oppose the erasure of your Personal Data and request the restriction of their use instead;
·
we no longer need your Personal Data for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims;
·
you have objected to the processing of your Personal Data, and wish to restrict their processing pending the verification of whether our compelling legitimate grounds for processing override your grounds for objecting to it.
Right to data portability You have the right to require us to provide to you the Personal Data that concerns you and that you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to require us to transmit those data to another controller.
Right to object You have the right to object to our processing of your Personal Data at any time if:

your Personal Data are processed for direct marketing purposes.

For the processing activities regarding your Personal Data for which consent is legally required, you may withdraw your consent at any moment should you wish to do so. However, this withdrawal will in no way affect the lawfulness of the processing that was based on consent before the withdrawal, or subsequent processing of the same Personal Data based on other legal bases such as the performance of a contract or a legal obligation to which we are subject.

We will treat your requests with particular care in order to assure the effectiveness of your rights. If necessary, we may also ask that you provide us with additional information in order to confirm you identity before responding to your request.

Please note that under certain circumstances, such as the existence of legal obligations, we may not be able to respond to your request immediately. We will notify you of the measures taken in relation to your request within a month, unless there are exceptional circumstances justifying an extension that shall not exceed two additional months. In such a case, we will inform you of the extension and the justifications for the extension within a month from the receipt of your request.
