1. Who is the Data Controller of Your Personal Data?

Unless expressly specified otherwise:

  • Nissan Motor Co., LTD (“Nissan”, “us”, “we”), incorporated at 2, Takara-cho, Kanagawa-ku, Yokohama-shi, Kanagawa 220-8623, Japan, is the data controller of personal data collected and processed for the administrative, operational and commercial management of the Site as publisher;
  • the recruiting Nissan entity is the data controller of personal data collected and processed for the process of your job application.

For the purpose of this Privacy Notice, “personal data” means all information relating to an identified or identifiable natural person as defined under applicable privacy and data protection laws, including, but not limited to, the Act on the Protection of Personal Information of Japan (“APPI”) and the European General Data Protection Regulation (“GDPR”) (together “Privacy and Data Protection Laws”).

However, Nissan does not provide any personal data to third-party companies without your express consent, unless we are allowed to do so under the applicable Privacy and Data Protection Laws. 5. How Does Nissan Protect Your Personal Data?

Nissan has implemented appropriate technical and organizational measures in order to maintain a level of security well adapted to the level of risk related to the processing of your personal data. These measures aim, in particular, to protect your personal data against destruction, loss, alteration, unauthorized disclosure or access, both accidental and intentional.
However, no method of transmission of data on the internet and no method of storage (in either an electronic or a physical environment) can be entirely secure. We endeavor to protect your personal data to the best of our abilities, but we cannot guarantee an absolute security or integrity during the transmission of your data from your system to ours. Any transmission is at your own risk.

6. Are There Any International Transfers of Your Personal Data?

Where the personal data is originated within a country requiring an adequate level of protection for personal data when disclosing or transferring personal data outside the originating country, Nissan ensures that appropriate legal or contractual safeguards are in place for such disclosures or transfers as required by the applicable law.

In particular:

  • where the APPI of Japan applies and we transfer your personal data outside of Japan, we will take all necessary measures through contracts based on the APPI and any applicable guidelines;
  • where the GDPR applies and we transfer your personal data outside the European Union/European Economic Area/United Kingdom, we will, in the absence of an adequacy decision and after having carried out an assessment of the level of protection of your rights on the territory of the concerned third country where we deem this necessary, implement adequate measures through the adoption of appropriate safeguards (such as standard contractual clauses).

7. How Long Do We Store Your Personal Data?

We retain your personal data for as long as it is necessary for the purposes set out in this Privacy Notice, unless required by our legal obligations to retain it for longer.
In order to determine the appropriate retention period, we consider factors such as:

  • your use of our Site and its services;
  • the existence of contractual or legal obligations requiring us to retain your personal data for a fixed period;
  • the existence of any ongoing legal proceedings.

8. What Are Your Rights Regarding Your Personal Data?

Depending on the applicable Privacy and Data Protection Laws, that apply to your situation you may be able to exercise the following rights regarding your personal data processing by Nissan:

Right to erasure You have the right to require the erasure of your personal data, when one of the following conditions applies:
  • Your personal data is no longer necessary for the purposes for which we collected it or otherwise processed;
  • you retract your consent on which the processing of your personal data is based, and we have no other legal basis for the processing;
  • you object to the personal data processing and we have no compelling legitimate grounds for processing your personal data;
  • the use that is made of your personal data does not comply with the applicable legal or regulatory provisions.
Right to restriction of processing You have the right to require the restriction of the personal data processing during a limited period of time, in particular in order to carry out some verifications, if one of the following conditions applies:
  • you contest the accuracy of your personal data, and wish to restrict the processing of your personal data during the period required of us to verify the accuracy of your personal data;
  • the personal data processing is unlawful and you oppose the erasure of your personal data and request the restriction of their use instead;
  • we no longer need your personal data for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims;
  • you have objected to the processing of your personal data, and wish to restrict their processing pending the verification of whether our compelling legitimate grounds for processing override your grounds for objecting to it.
Right to data portability You have the right to require us to provide you with your personal data that you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to require us to transmit this data to another data controller. This right is not exercised in all circumstances, it applies only if it fulfils all the following conditions:
  • your request is only related to your personal data (excluding anonymous or third-party data);
  • your request does not adversely affect the rights or freedoms of others, in particular those of Nissan (including trade secrets);
  • the processing is carried out by automated means (paper files are therefore not included);
  • the processing is based on consent or the performance of a contract (to check if it is the case, you can see the section 3 of this Privacy Notice).
Right to object You have the right to object to our processing of your personal data at any time if:
  • the processing is based on our legitimate interest; or
  • your personal data are processed for direct marketing purposes.
Nissan will no longer process your personal data unless Nissan demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, such as the respect of a legal obligation (e.g. legal obligation involving the retention of personal data), or for the establishment, exercise or defense of legal claims.
Right to withdraw your consent You have the right to withdraw your consent when it has been obtained, without this withdrawal affecting the lawfulness of the personal data processing operations previously carried out.

You have control regarding our use of personal data for directing marketing. If you no longer wish to receive any marketing communications, remain on a mailing list to which you previously subscribed, or receive any other marketing communication, you can choose to not receive such communications at any time. Please follow the unsubscribe link in the relevant communication or contact us.

Depending on your country of residence, you may have additional local rights with respect to our processing of personal data. Please note that some of the personal data that we collect, use and share may be exempt from the rights outlined above.

We will treat your requests with particular care in order to assure the effectiveness of your rights. If necessary, we may also ask that you provide us with additional information in order to confirm your identity before responding to your request. This is another appropriate security measure to ensure that personal data is not disclosed to an individual who does not have the right to receive it.
Please note that under certain circumstances, such as the existence of legal obligations, we may not be able to respond to your request immediately. We will notify you of the measures taken in relation to your request within a month, unless there are exceptional circumstances justifying an extension that shall not exceed two additional months. In such a case, we will inform you of the extension and the justifications for the extension within a month from the receipt of your request.
